Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her decision, the judge pointed out that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court challenge center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.
